Terms of Service
1. Acceptance
By accessing ToolOracle ("Service", "Platform") at tooloracle.io or any MCP endpoint, you agree to these Terms. If you do not agree, do not use the Service. "You" refers to any individual, AI agent, or organization using the Service.
2. Services Description
ToolOracle provides MCP (Model Context Protocol) servers offering tools across compliance, trust, finance, business intelligence, and travel categories. The Service includes free-tier tools and paid tools via x402 micropayments. ToolOracle is operated by Murat Keskin (see Impressum), with infrastructure provided by FeedOracle.
3. x402 Payments
Paid tools are accessed via the x402 protocol using USDC on the Base blockchain. By sending a payment, you acknowledge that blockchain transactions are irreversible. Pricing is displayed per tool call (1 unit = $0.01 USDC). Pricing may change; current prices are returned in the 402 response. No refunds are provided for completed, successfully executed tool calls.
4. Free Tier
Free-tier tools are provided without charge and without warranty. We reserve the right to rate-limit, modify, or discontinue free-tier access at any time without notice.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Attempt to gain unauthorized access to any system, server, or network
- Overload, disrupt, or interfere with the Service's infrastructure
- Use the Service to generate, store, or distribute harmful, abusive, or illegal content
- Circumvent rate limits, authentication, or payment mechanisms
- Resell or redistribute Service outputs without attribution
6. Data & MemoryOracle
MemoryOracle stores data that agents actively submit. You retain ownership of all data you submit. You are responsible for ensuring that submitted data does not violate any third-party rights. We provide tools for data export (GDPR Art. 20) and deletion (GDPR Art. 17). See our Privacy Policy for details.
7. Intellectual Property
ToolOracle's software, branding, and documentation are protected by copyright. MCP tool outputs are provided for your use; you may use them in your applications. The MIT license applies to open-source components published on GitHub.
8. No Financial or Legal Advice
ToolOracle provides information and data tools, not financial, legal, regulatory, or investment advice. Decision Preflight verdicts (go/caution/stop) are automated assessments, not legal opinions. You are solely responsible for your compliance decisions. Always consult qualified professionals for regulatory matters.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or force majeure may cause temporary outages. We are not liable for losses arising from service interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, ToolOracle's total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that tool outputs are accurate, complete, current, or error-free. MiCA, DORA, and other regulatory data should be independently verified.
12. Indemnification
You agree to indemnify and hold harmless ToolOracle, its operator, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access for violation of these Terms or for any reason with reasonable notice. Upon termination, you may export your MemoryOracle data. Blockchain payments already made are non-refundable.
14. Changes
We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via the website.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is Detmold, Germany, to the extent legally permissible.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
